ICE's Takeover Plan Comes Under Antitrust Scrutiny

Law360, New York (January 14, 2009, 12:00 AM ET) -- Antitrust regulators are reportedly probing IntercontinentalExchange Inc.'s proposed acquisition of independent clearinghouse Clearing Corp., a move that is part of ICE's business plan for clearing credit default swaps.

ICE has confirmed that the Antitrust Division of the U.S. Department of Justice is reviewing its pending takeover of Clearing Corp., which comes as one aspect of its larger business plan that is still awaiting the green light from the New York Federal Reserve and the U.S. Securities and Exchange Commission, Dow Jones reported Tuesday.
