Law360, New York (February 09, 2009, 12:00 AM ET) -- Bank of America Corp. has asked a judge to force Every Penny Counts Inc. to comply with a discovery request in the ongoing patent fight over the bank's “Keep the Change” program.
In a motion filed Friday in the U.S. District Court for the Middle District of Florida, BofA and co-defendant Bank of America NA asked the judge to compel EPC to respond to the its fifth set of interrogatories by providing information regarding a claim for the patent in dispute, U.S. Patent Number 6,112,191....
