Law360, New York (February 24, 2009, 12:00 AM ET) -- A federal appeals court has denied a preliminary injunction request in a shareholder derivative suit seeking to void the 2008 elections of the board of directors for Goldman Sachs Group Inc., affirming a lower court ruling.
The U.S. Court of Appeals for the Second Circuit on Monday ruled that the appeal by shareholder Jeffrey W. Bader was moot because the company had already issued its 2008 annual proxy statement and the election had already taken place.
