Law360, New York (July 27, 2009, 5:22 PM ET) -- Strapped automotive wheel manufacturer Hayes Lemmerz International Inc. has asked a bankruptcy court to weigh in on a dispute with the U.S. Bank National Association over certain terms of their indenture agreement that the company claims are central to its Chapter 11 exit.
On Friday, Hayes Lemmerz filed a motion for declaratory judgment with the U.S. Bankruptcy Court for the District of Delaware, expressing concern that the lack of clarity on the indenture question could force the company into an unnecessary liquidation.
