Law360, New York (August 26, 2009, 6:20 PM ET) -- A group of noteholders in Spansion Inc.'s Chapter 11 case is asking the bankruptcy court for permission to sue Samsung Electronics Co. Ltd. in order to stop the company from pursuing a patent case against the debtor before the U.S. International Trade Commission.
The ad hoc consortium of floating rate noteholders on Tuesday asked the U.S. Bankruptcy Court for the District of Delaware for standing to enforce the automatic stay against what it called Samsung's “in terrorem litigation tactics.”
