Law360, New York (October 20, 2009, 3:33 PM ET) -- Samsung Electronics Co. Ltd. is appealing a bankruptcy judge's decision to stay an infringement complaint the electronics giant filed against bankrupt Spansion Inc. in the U.S. International Trade Commission.
Samsung filed a notice of appeal Monday in the U.S. Bankruptcy Court for the District of Delaware indicating its intent to challenge Judge Kevin J. Carey's decision that the automatic stay in Spansion's bankruptcy applies to the ITC action.
