BofA Slams Bid To Group Cases Over $2B Casino Financing

Law360, New York (May 01, 2012, 5:35 PM ET) -- Bank of America NA asked the Eleventh Circuit on Monday to deny a motion to consolidate several appeals springing from multidistrict litigation over a $1.85 billion financing agreement for now-bankrupt Fontainebleau Las Vegas Holdings LLC's casino resort project.

The bank argued that grouping a case over an allegedly breached disbursement agreement with three other appeals over a credit agreement for the project would cause delays and extra work for the court. The motion to consolidate the cases had been lodged by a group of term lenders...
