Judge Denies Appeal In Fidelity Mortgage FLSA Suit

Law360, New York (December 11, 2007, 12:00 AM ET) -- A federal judge overseeing a wage-and-hour collective action against Delta Financial Corp. has denied the company’s request to appeal the court’s summary judgment order.

Judge Gary L. Lancaster of the U.S. District Court for the Western District of Pennsylvania on Friday refused to allow Delta Financial, which owns Fidelity Mortgage Inc., to file an interlocutory appeal of his May order granting in part and denying in part summary judgment motions filed by both Fidelity and the plaintiff.
