Judge Spurns Class Bid In W.R. Grace Case

Law360, New York (May 30, 2008, 12:00 AM ET) -- The judge presiding over W.R. Grace's Chapter 11 proceedings has shot down a hospital's bid for class certification on behalf of property owners, ruling that at this juncture such a move would unnecessarily disrupt the case and harm everyone involved.

On Thursday, U.S. Bankruptcy Judge Judith K. Fitzgerald denied the request of Anderson Memorial Hospital, finding that the South Carolina facility had not met the numerosity criteria necessary to represent property owners whose buildings allegedly contain W.R. Grace's asbestos-laced material.
