Law360, New York (October 15, 2009, 1:33 PM ET) -- Sears Roebuck & Co. and Whirlpool Corp. have again won the dismissal of a putative class action alleging they engaged in unfair competition and misleadingly marketed thousands of defective washing machines.
Judge Jeremy Fogel of the U.S. District Court for the Northern District of California on Tuesday granted Sears and Whirlpool's motion to dismiss the amended complaint, although the plaintiffs were given leave to amend a second time.
