Law360, New York (November 06, 2009, 6:38 PM ET) -- Business leaders are hoping the U.S. Supreme Court will grant companies a measure of control in diversity jurisdiction cases by letting them emphasize the location of their corporate headquarters in tests to determine their “principal place of business.”
That seemingly simple phrase is at the core of Hertz Corp. v. Friend, a case that could resolve a circuit split over exactly what characteristics judges should consider when trying to determine whether to remove local cases to federal court.
