Law360, New York (October 30, 2009, 3:30 PM ET) -- The Flintkote Co.'s suit against Aviva Insurance Co. of Canada to recover for asbestos-related personal injury suits will continue following a judge's refusal to issue summary judgment for the bankrupt asbestos-mining company.
Judge Marilyn Patel of the U.S. District Court for the Northern District of California on Thursday declined to grant Flintkote's motion for summary judgment on its claim of violation of an insurance policy's implied covenant of good faith and fair dealing, ruling that triable issues remain in the matter.
