Unilever Hits Back At 'I Can't Believe It's Not Butter' Suit

Law360, New York (December 01, 2009, 12:54 PM ET) -- Unilever U.S. Inc. is seeking dismissal of a proposed class action alleging the company falsely advertises its I Can't Believe It's Not Butter brand of spread as more nutritious than butter, citing federal preemption regulations.

Unilever maintains that the suit filed by consumer Amnon Rosen amounts to an attack on nonactionable sales pitches in the advertising for the spread, according to the motion for dismissal filed Monday in the U.S. District Court for the Northern District of California.
