9th Circ. Nixes Denial Of ConocoPhillips FLSA Class

Law360, New York (January 06, 2010, 5:57 PM ET) -- In a putative class action accusing ConocoPhillips Co. of failing to provide meal periods to workers at several California refineries, a federal appeals court has ruled that a lower court abused its discretion by denying certification based on the possibility that the plaintiffs might not prevail on their primary legal theory.

The U.S. Court of Appeals for the Ninth Circuit ruled Wednesday that the U.S. District Court for the Central District of California had improperly denied class certification, and remanded the case for reconsideration.
