Law360, New York (May 11, 2010, 1:52 PM ET) -- A federal judge has shot down a proposed class action accusing Unilever United States Inc. of falsely advertising its I Can’t Believe It’s Not Butter brand of spread as being more nutritious than traditional butter.
Judge James Ware of the U.S. District Court for the Northern District of California granted food conglomerate Unilever’s motion to dismiss on May 3, finding that the plaintiffs’ claims could not stand under the heightened pleading standards the U.S. Supreme Court established in Twombly and Iqbal.
