Law360, New York (September 15, 2010, 12:59 PM ET) -- Pacific International Vegetable Marketing Inc., which was sued by consumers for providing contaminated lettuce to a Wendy's restaurant, has reached an agreement with National Surety Corp. and TWIW Insurance Services LLC that settles a dispute over defense coverage.
Magistrate Judge Edward Chen of the U.S. District Court for the Northern District of California signed a stipulated order Tuesday that allows the parties to drop all the remaining claims and counterclaims relating to Pacific's coverage for the underlying litigation over the tainted lettuce.
