Law360, New York (December 17, 2010, 1:47 PM ET) -- A federal judge has mostly rejected competing summary judgment motions filed by medical device makers Conceptus Inc. and Hologic Inc. in their patent infringement fight over permanent, noninvasive contraceptive systems.
In an order Thursday, Judge William Alsup of the U.S. District Court for the Northern District of California refused to rule that Hologic's Adiana birth control system infringes a patent held by Conceptus. But he also declined to find that two linked claims of the patent-in-suit are invalid and not infringed.
