Auto Insurers Can't Shake Repair Part Antitrust Suit

Law360, New York (March 25, 2011, 4:01 PM ET) -- A California federal judge on Wednesday denied the dismissal and summary judgment bids of Allstate Indemnity Co. and other auto insurers hoping to escape a putative class action alleging they set up a sham organization to prevent competition over repair parts.

Judge James Ware of the U.S. District Court for the Northern District of California found that the named plaintiffs in the suit had met certain pleading requirements and that summary judgment at this stage of the proceedings would be premature.
