Judge Blasts FedEx For Late Disclosure

Law360, New York (July 24, 2007, 12:00 AM ET) -- A group of drivers who sued FedEx Ground Package System Inc. over their classification as independent contractors won an important victory on Monday, when a judge barred hundreds of declarations by other drivers in support of the company from being used as evidence.

Judge Christopher Nuechterlein of Indiana ruled that FedEx had “not proceeded in candor and good faith,” springing the witnesses' declarations on the plaintiffs at the end of discovery without having made an adequate disclosure long before.
