Judge Tosses Rival Condom Maker's Claims Against Trojan

Law360, New York (April 12, 2012, 6:43 PM ET) -- A California federal judge has given Trojan condom maker Church & Dwight Co. Inc. a win in its antitrust suit against rival Mayer Laboratories Inc., saying that a C&D rebate program did not constitute anti-competitive behavior, according to an order made public Thursday.

In the public version of a March 1 order, U.S. District Judge Edward M. Chen said that Mayer, which makes Kimono brand condoms, had failed to provide enough evidence to sustain its counterclaims that C&D used a rebate program to secure its condoms...
