Abbott Loses Appeal Bid In HIV Drug Litigation

Law360, New York (July 08, 2008, 12:00 AM ET) -- Abbott Laboratories has failed in its bid for an interlocutory appeal to determine whether an appeals court’s decision regarding bundled discounts applies to four antitrust suits targeting Abbott’s HIV treatments Norvir and Kaletra.

Judge Claudia Wilken of the U.S. District Court for the Northern District of California refused Monday to certify an appeal based on a possible link between the plaintiffs’ cases against Abbott and the U.S. Court of Appeals for the Ninth Circuit’s decision in Cascade Health Solutions v. PeaceHealth.
