FTC Clears Air With $6.5M Airborne Settlement

Law360, New York (August 14, 2008, 12:00 AM ET) -- Airborne Health Inc. has agreed to settle U.S. Federal Trade Commission allegations that it didn't have adequate evidence to support its advertising claims by adding $6.5 million to a $23.5 million settlement fund.

The FTC said Thursday that if a court approves the settlement, Airborne and its fellow defendants -- Victoria Knight-McDowell, the former schoolteacher who invented the product, and her husband Thomas John McDowell – will be prevented from making false and unsubstantiated cold prevention, germ-fighting and efficacy claims.
