Law360, New York (October 01, 2008, 12:00 AM ET) -- Sportswear maker Asics Corp. is suing high-end fashion designer Dolce & Gabbana SRL for selling shoes with a stripe design similar to Asics' athletic shoes.
In a complaint filed Monday in the U.S. District Court for the Central District of California, Japan's Asics accuses Italy's D&G of trademark infringement, trademark dilution, false advertising and unfair competition.
The suit shows five D&G brand shoes bearing marks similar to Asics' trademark — two parallel stripes along the side of the shoe with two wavy stripes crossing over them....
