Objection To $835M Dow Price-Fixing Settlement Overruled
A Kansas federal judge on Friday approved an $835 million settlement between Dow Chemical and a customer class alleging it fixed prices on a foam product ingredient, overruling objections by PMC Global Inc. and calling the manufacturer's claims for purchases between 1999 and 2000 "simply dead."

Manufacturer PMC Global Inc. on Monday told a Kansas federal court it objected to a plan to allocate an $835 million settlement with Dow Chemical over price-fixing allegations, saying the fund should reimburse class members who purchased an ingredient used in foam products during 2000 and earlier.

The Dow Chemical Co. on Thursday appealed an amended $1.06 billion judgment entered against it in Kansas federal court to to the Tenth Circuit, arguing the lower court miscalculated the damages in an antitrust class action alleging Dow schemed with BASF Corp., Huntsman International LLC and other rivals to fix the price of urethane.
