A New York federal judge ruled that Del Monte Corp. didn't violate an injunction in a false labeling suit over unnecessarily refrigerated packaged fruit on Monday, refusing to hand Fresh Del Monte Produce Inc. more damages than the $13 million it won at trial.

A New York federal judge on Thursday hit Del Monte Corp. with an injunction banning the company from mislabeling products to create the illusion they contain fresh fruit, a year after a jury awarded $13 million to rival Fresh Del Monte Produce Inc. in a trademark and false advertising dispute.

A New York federal jury determined Friday that preserved fruit company Del Monte Foods Co. misled consumers with its refrigerated products and awarded Fresh Del Monte Produce Inc. $13.15 million for the alleged mislabeling and for breach of a trademark licensing agreement between the companies.
