Insurer Beats Early Win Bid In $50M Pollution Award Fight
An Indiana federal judge on Thursday refused to rule that Westfield Insurance Co. breached its duty to defend a recycling plant in a pollution class action that resulted in a $50 million default judgment against the facility, saying there is insufficient evidence in the record to render a decision on the issue.

Westfield Insurance Co. told an Indiana federal court on Friday that it owes no part of a $50.57 million judgment owed by a waste disposal facility to a class of neighbors who sued over pollution from the facility, saying the court already decided the relevant insurance policies didn't cover the claims in the suit.

An Indiana federal court judge refused on Thursday to release Soil Solutions Co. from a class action brought by Indiana residents that seeks to hold the waste disposal company liable as successor in interest for the mandated cleanup of an Elkhart, Ind., waste facility it acquired in July.
