The Ninth Circuit agreed Wednesday to hear a consumer's appeal of a California federal court's denial of class certification in her suit accusing Ford Motor Co. of failing to disclose an alleged defect in its Freestyle vehicles that cause them to repeatedly surge forward while braking.

Ford Denies Liability In Freestyle Brake Suit
Ford Motor Co. asked a California federal judge on Friday to throw out a putative class action over an alleged brake defect in its Freestyle vehicles, arguing the company had no legal duty to disclose because the plaintiff purchased the car from a third party.
