BNSF Railway Co. on Thursday settled a dispute with the government that had been remanded to a Texas federal court after the Fifth Circuit found last year the company can't receive refunds for taxes it paid on certain employee stock options because they qualify as compensation.

A Texas federal judge on Thursday ruled in favor of BNSF Railway Co. in its suit against the U.S. government seeking a $22 million tax refund, determining that BNSF's stock options and relocation reimbursement employee benefits are not taxable compensation under the Railroad Retirement Tax Act.
