The U.S. Equal Employment Opportunity Commission urged an Illinois federal court Tuesday to proceed with discovery in its sex discrimination suit against Mach Mining LLC even though the U.S. Supreme Court has agreed to review the case over whether courts can second-guess the agency's mandatory presuit efforts to conciliate bias claims.

The U.S. Equal Employment Opportunity Commission sued Mach Mining LLC on Tuesday in Illinois, alleging the coal mine operator hadn't hired any female miners since setting up shop in 2006, despite having received applications from highly qualified women.
