Lexington Insurance Co. and Sierra Health Services Inc. entered a confidential settlement Thursday in Nevada federal court releasing a $2 million policy to Sierra Health and ending litigation over Lexington's duty to defend the health insurer in an underlying class action over a hepatitis C outbreak.

Lexington Insurance Co. on Thursday argued that it has no obligation under a primary policy to defend two United Healthcare Services Inc. units facing a $500 million damages verdict and underlying class action litigation over a hepatitis C outbreak, because it deposited the $2 million liability limit with the court.

Lexington Insurance Co. sued United Healthcare Services Inc. and several of its subsidiaries in Nevada federal court Wednesday alleging it owes no coverage for a $500 million punitive damages verdict, class action litigation and other claims stemming from a hepatitis C outbreak.
