Publishers Want En Banc Rehearing On GSU Fair Use Ruling
Oxford University Press Inc. and other academic publishers are asking the full Eleventh Circuit to rehear their copyright case against Georgia State University, saying a ruling from a panel of the court's judges last month "diverged sharply" from U.S. Supreme Court precedent on fair use.

The Eleventh Circuit on Friday vacated a decision holding that digital excerpts of books from Oxford University Press Inc. and two other academic publishers provided to students at Georgia State University were protected by fair use, finding a lower court should have used a more "holistic" fair-use analysis.

Georgia State University is relying on "blindered" arguments to support its practice of distributing copyrighted reading materials to students through e-reserves, three academic publishers told the Eleventh Circuit on Monday, urging the court to reverse a ruling that the practice was mostly protected by fair use.
