9th Circ. Revives San Fran Police Officers' Class Cert. Bid
The Ninth Circuit on Thursday revived a class certification bid by a group of more than 30 police officers in their age discrimination suit against the city and county of San Francisco, finding that a lower court erred by disregarding the existence of common legal and factual questions and addressing the merits of the putative class' claims.

More than 30 San Francisco Police Department officers urged the Ninth Circuit on Tuesday to revive their bid for class certification in their age discrimination suit, arguing that a California federal judge wrongly applied Dukes v. Wal-Mart when she ruled that the officers failed to show they had common claims.
