The Second Circuit upheld class certification for more than 100,000 consumer debtors who allegedly fell prey to a fraudulent debt-collection default judgment scheme by a Leucadia National Corp. debt-buying affiliate and its law firm and process server, finding Tuesday that common issues predominated.

FDCPA Covers Fraud On The Court, Regulators Tell 2nd Circ.
The Consumer Financial Protection Bureau and Federal Trade Commission recently urged the Second Circuit to reject a law firm and other class action defendants' argument that the Fair Debt Collection Practices Act doesn't cover fraudulent communications with courts and others not affiliated with the debtor.
