    The Third Circuit affirmed Thursday a lower court's ruling that Nationwide Mutual Insurance Co. doesn't need to defend a Pennsylvania commercial roofing company in class action litigation alleging it sent unsolicited faxes, saying the faxes were sent intentionally and could not be considered accidental.

    A Pennsylvania commercial roofer pushing for indemnity from Nationwide Mutual Insurance Co. in a class action over alleged violations of the Telephone Consumer Protection Act was unaware that faxes sent on its behalf could violate the law, a company attorney told a Third Circuit panel Thursday.
