The D.C. Circuit's order for the U.S. Department of Energy to stop hitting nuclear power plant operators with waste fees totaling about $750 million each year is illegal and tramples on the judgment of both the Secretary of Energy and Congress, the agency told the appeals court Friday.

The D.C. Circuit ordered the U.S. Department of Energy on Tuesday to stop hitting nuclear power plant operators with waste fees totaling about $750 million each year, ruling that collection should be suspended entirely until it finds a viable storage alternative to the canceled Yucca Mountain facility.
