The Eleventh Circuit refused Wednesday to rehear en banc a decision upholding the dismissal of claims brought by plaintiffs in a suit against Franklin Collection Service Inc. several months after the court revived one of their Fair Debt Collection Practices Act claims in a precedential ruling.

The Eleventh Circuit found Thursday in a precedential ruling that the Fair Debt Collection Practices Act prohibits collection agencies from charging consumers a percentage of their principal account balance unless the debtor had explicitly assumed responsibility for such fees.
