Pa. Case Challenging Malpractice Insurer Faces Long Odds
The Third Circuit delivered a rare win for the plaintiffs' side when it sent a Pennsylvania dispute over coverage for a $4.2 million legal malpractice verdict back to state court, but experts doubt the case will prompt the court to revisit insurer-friendly case law that places a heavy notification requirement on attorneys and makes it harder for plaintiffs to recover.

3rd Circ. Clarifies Declaratory-Judgment Dismissal Rules
The Third Circuit ruled Tuesday that a district court could decline to exercise jurisdiction over a declaratory judgment suit even when there are no parallel proceedings underway in state court, upholding a Pennsylvania federal judge's decision not to touch an insurance suit stemming from a $4.2 million legal malpractice verdict.

Westport Insurance Corp. on Tuesday urged the Third Circuit to rule that a Pennsylvania resident's effort to make it pay $4.2 million stemming from a legal malpractice claim belonged in federal court, arguing that federal courts lack the discretion to kick aside a case that centered on damages.
