BNSF Blasts 5th Circ.'s 'Sweepingly Broad' Tax Decision
In response to BNSF Railway Co.'s recent loss before the Fifth Circuit over whether it deserved a refund on taxes paid on employee stock options, the company asked the court for a rehearing Tuesday, saying the court's previous "sweepingly broad" ruling allows administrative agencies to run amok.

5th Circ. Flips BNSF Railway Tax Refund Ruling
The Fifth Circuit ruled Thursday that BNSF Railway Co. can't receive refunds for taxes it paid on certain employee stock options because the options qualify as compensation, but said a tax refund claim for employee moving expenses that the company funded needs further deliberation.
