The Fourth Circuit on Thursday dismissed an appeal from two attorneys hit by a $7.3 million damages and attorneys' fee award in a racketeering suit brought by CSX Transportation Inc., ending allegations that the railroad company sued them in retaliation for filing asbestos claims by its employees.

CSX Transportation Inc. told the Fourth Circuit on Monday that the attorneys challenging its $1.3 million damages award had committed gross fraud by filing false asbestos claims, arguing that it should be allowed to seek punitive damages in any new trial over its common-law claims against them.
