Insurer Beats Pharmacy's Bid To Ax Junk-Fax Coverage Suit
A Florida federal judge on Wednesday refused to toss Maryland Casualty Co.'s suit seeking to dodge coverage for Superior Pharmacy LLC in a class action alleging it sent unsolicited fax advertisements, rejecting the pharmacy's argument that the claim isn't ripe because the class action doesn't assert wrongdoing during the policy period.

Maryland Casualty Co. sued in Florida federal court on Tuesday to avoid covering a Tampa-area pharmacy chain's defense of a proposed class action over junk faxes, raising a variety of defenses to coverage, including that it received late notice of the underlying lawsuit.
