A Florida federal judge on Wednesday refused to toss Maryland Casualty Co.'s suit seeking to dodge coverage for Superior Pharmacy LLC in a class action alleging it sent unsolicited fax advertisements, rejecting the pharmacy's argument that the claim isn't ripe because the class action doesn't assert wrongdoing during the policy period.
