A New York federal judge on Tuesday dismissed a shareholder derivative suit against Bank of America Corp. over Countrywide Financial's "hustle" high-speed mortgage approval process, saying the plaintiff couldn't show the bank's board breached its duty when she filed the suit before it responded to her demand.
