Law360, New York (May 22, 2009, 12:00 AM ET) -- The lawyer for the salaried retirees of agricultural machinery maker Massey Ferguson Inc. has alleged the entity now in charge of their health care benefits unilaterally changed the plans in violation of a magistrate judge's order.
In the U.S. District Court for the Eastern District of Michigan on Thursday, the plaintiffs' lawyer filed a motion for an injunction restoring health benefits to those agreed to in a 1997 deal settling an action over Massey Ferguson's “unilateral” change of plans.
