First American Can't Shake Title Rate Class Action

Law360, New York (July 06, 2009, 12:00 AM ET) -- Dealing a blow to First American Title Insurance Co., a federal judge has refused to dismiss a putative class action alleging the nation’s largest title insurer denies homeowners discounted premiums for refinanced mortgages.

Judge George Z. Singal of the U.S. District Court for the District of Maine ruled Wednesday that the complaint adequately stated a cause of action, letting stand allegations that First American routinely overcharges refinancing customers in violation of the Maine Unfair Trade Practices Act.
