SEC, the Supreme Court held that the U.S. Securities and Exchange Commission's in-house administrative law judges, or ALJs, are subject to the appointments clause of the Constitution and are not regular government employees. In Digital Realty Trust Inc. v. Paul Somers, the court unanimously found that a whistleblower who was fired after reporting alleged financial misconduct internally was not entitled to the protection of the Dodd-Frank Act's anti-retaliation provisions because he did not report his allegations to the SEC first....
