Law360, New York (July 31, 2009, 6:30 PM ET) -- A federal judge has demanded some calm be brought to four antitrust actions against pharmaceutical company Cephalon Inc. related to generic competition for narcolepsy drug Provogil, clearing a raft of pending motions to dismiss and ordering the plaintiffs to file amended complaints.
Judge Mitchell S. Goldberg of the U.S. District Court for the Eastern District of Pennsylvania denied without prejudice all pending motions to dismiss in four antitrust suits against Cephalon, and gave the parties guidelines on how and when to file new briefs.
