Suit Says Sony PS3 Update Causes Unit Breakdown

Law360, New York (October 05, 2009, 12:31 PM ET) -- A Sony Computer Entertainment America Inc. customer is alleging that a software system update for PlayStation 3 causes the units to malfunction and require repairs, in a proposed class action making claims including breach of implied warranty and negligence.

In a lawsuit filed Friday in the U.S. District Court for the Northern District of California, plaintiff John Kennedy said that Sony failed to perform adequate testing of the update and failed to warn customers of possible problems.
