Pizza Hut Delivery Drivers' Overtime Suit Tossed

Law360, New York (October 08, 2009, 12:56 PM ET) -- A federal judge has tossed a proposed collective and class action against a Pizza Hut franchisee after finding that the lead plaintiffs failed to adequately plead that their wages did, in fact, fall below the required minimum wage.

Judge Richard H. Kyle of the U.S. District Court for the District of Minnesota on Tuesday signed an order dismissing federal claims against Border Foods Inc. and Sky Ventures LLC with prejudice.
