Law360, New York (November 01, 2006, 12:00 AM ET) -- France’s counsel of ministers and Conseil d’Etat, its highest judicial public law authority, are currently debating whether the country should bring over a highly controversial import from the United States—the class action lawsuit.
The Conseil d’Etat will examine a preliminary draft of a new law translated as “in favor of the consumers,” which could be presented to the council of ministers next week. At present, there is no such thing as a “group suit” in the French legal system.
