Bellwether Consolidation Denied In Levaquin MDL

Law360, New York (December 15, 2009, 7:27 PM ET) -- The federal judge overseeing the multidistrict litigation over Johnson & Johnson's antibiotic Levaquin has turned down a request by the plaintiffs to choose and consolidate several bellwether cases for trial, saying it was too early in the process and that he needed more information.

Judge John R. Tunheim denied the plaintiffs' motion without prejudice and said he expected them to try again after further discovery, according to the order, filed Monday in the U.S. District Court for the District of Minnesota.
