Wal-Mart, J&J Toxic Baby Products Suit Stays Alive

Law360, New York (April 19, 2010, 1:12 PM ET) -- Johnson & Johnson Consumer Cos. Inc. and Wal-Mart Stores Inc. have lost a bid to dismiss a class action alleging the companies failed to warn consumers their baby hygiene products were contaminated with toxic chemicals.

Judge Dennis Cavanaugh of the U.S. District Court for the District of New Jersey issued the ruling Thursday, saying the plaintiff can proceed with claims related to Johnson & Johnson's Baby Shampoo and Wal-Mart's Equate Tearless Baby Wash. Claims against a third defendant, Kimberly-Clark Corp., were dismissed.
